PUTTING POLITICS ON THE BACKBURNER
The Case Against Political Insignia in the Workplace
In the ever-evolving landscape of professional environments, where diverse perspectives merge, the debate over the presence of political insignia in the workplace has become increasingly poignant. It is not uncommon to see expressions of allegiance, be it political or social, manifesting at the workplace in the form of pins, bumper stickers, and even clothing. The question however arises: Does the workplace, a space dedicated to collaboration, productivity, and unity, have room for the expression of political affiliations?
The National Bargaining Council for the Chemical Industry (NBCCI) confirmed in a recent arbitration in NUMSA obo Kwena Masha v PFG Building Glass that unless an employer is a political organisation, employers have a general duty to create and maintain politically neutral working environment. In this case the commissioner acknowledged that a level of political intolerance still exists in South Africa and an employer’s failure to manage same could lead to unnecessary tension.
The Commissioner confirmed that an employer can introduce a company policy in order to manage and mitigate risk in this regard and that an employer must ensure that the rule is applied consistently through all levels of management.
We understand the challenges faced by employers to manage tensions in the workplace and therefore we provide a draft general workplace policy to be amended to suit your company’s needs.
